Happy Friday, Longmont! The scariest weekend of the year is upon us. Whether you celebrate with scary movies, haunted houses or spooky costumes, be sure to celebrate responsibly — don’t give toothpaste to trick-or-treaters.

Today — a Longmont cop won’t be facing any criminal charges, Silver Creek High School dominates in the state tournament, and a peek at some of the best ways to celebrate Halloween in Longmont.

Let’s dive in.

TOP STORY
🌎 Longmont cop cleared of wrongdoing after killing 20-year-old

The Longmont police officer who shot and killed 20-year-old Dariss Yearby is in the clear.

The Boulder County District Attorney’s Office announced yesterday the investigation into the actions of Longmont Police Officer Joshua Barry had been completed and found no criminal charges “can or should be filed.”

Boulder County District Attorney Michael Dougherty said Barry’s actions were “objectively reasonable.”

Let’s rewind:

On August 10, three Longmont Police officers arrived at a home where Yearby was holding a woman by her neck while his right hand — which was concealed by a large brown handbag — pointed toward her neck.

  • Yearby told officers multiple times he had a gun, though the woman told officers repeatedly that he didn’t. “He just wants you to kill him,” she said, insisting that he was suicidal and pleading with officers not to shoot. It was also communicated over dispatch that Yearby was suicidal.

  • Yearby refused to comply with repeated commands from officers to drop the gun and let the woman go.

  • Barry was the last of three responding officers to arrive, and ordered Yearby several times to drop the gun before shooting him. Police never found a gun in the room.

At the time of this shooting, Yearby had a pending criminal case against him in which he was charged with attempted murder of the same victim.

New details:

According to the DA’s office…

  • Prior to the August 10 incident, Yearby had indicated he didn’t want to return to jail and, if necessary, he would cause officers to take his life.

  • Barry had attended a training involving live fire hostage scenarios a week before the incident.

  • The other reporting officers stated they believed their lives — and to a higher degree, the victim’s life — were in danger.

The controversy:

At an October 6 Longmont City Council meeting, close to 50 members of Yearby’s family attended to lobby the seven-member team to hold Longmont Police accountable. They perceived Barry’s actions (per bodycam footage) as careless and excessively aggressive and criticized Longmont Police for its handling of public communication during the fallout of the incident.

Zooming out:

“This shooting and the loss of Mr. Yearby’s life is incredibly tragic. I feel terrible for everyone involved in, and impacted by, this domestic violence incident,” Dougherty stated.

Dougherty’s full report can be read here. The DA also conducts a town hall after every investigation of this caliber. Individuals interested can attend the virtual meeting on November 3 at 11 am. Learn more here.

It’s hard to excel at anything for 12 years. But, it happens. Grossen Bart Brewery is celebrating its 12th anniversary and its team wants you in attendance to help them party. Save the date: On December 12, Grossen Bart will host live music from three different bands, food trucks will be available, and a brand new beer will be released. Can’t make it on the 12th? The brewery is hosting a pre-party on the 11th. Can’t attend either day? Might as well just stop by this weekend, take in some football, and enjoy good company. Find your community at Grossen Bart Brewery, 1025 Delaware Ave.

3 Big Things

Shooting sends one to the hospital: A man was taken to the hospital Wednesday morning after suffering a gunshot wound to the leg, according to City of Longmont Spokesperson Tracey Hewson. The incident happened around 9:30 a.m. on the 1400 block of Emery Street. It’s unclear whether the wound was self-inflicted or there was another individual who fired the weapon, as Hewson declined to elaborate on the events that led up to the gunshot. But, it was confirmed no arrests were made. The investigation remains ongoing and there is no threat to the community.

Silver Creek soccer cruises in first round of state tournament: Silver Creek High School’s soccer squad is on to the second round of the CHSAA state tournament after toppling Discovery Canyon 7-2. The Raptors were led by a four-goal performance from senior Parker Brown. Next Wednesday, Silver Creek goes back on the road where a showdown with eighth-ranked Lewis Palmer awaits. Should the Raptors pull out a win in round two, they’ll likely have top-ranked Mullen waiting in the wings. They have only one loss this season, and breezed by their first round opponent Pueblo County by a score of *checks notes* 10-0.

Councilmember to begin “Council on the Bus” series: Longmont City Councilmember Alex Kalkhofer is doing his part to help get locals to the airport. In an effort to help familiarize residents with Longmont’s new bus service to Denver International Airport, Kalkhofer announced Tuesday that he’ll be guiding residents through the whole process. Kalkhofer noted that some sessions he’ll just be posted up at 8th Avenue and Coffman Street (bus pickup site) helping riders get started and on the bus, and other times he’ll be riding with locals the whole way. The Ward 3 councilmember added that there will be Spanish options as well.
